It would be in fitness of the fact to recall the greatest of Arab historians, Ibn Khaldun saying: “That in civilization there is a limit that cannot be overstepped. When prosperity and luxury come to a people, they are followed by excessive consumption and extravagance, with which the human soul itself is undermined, both in its worldly well-being and in its spiritual life”,[1] particularly in context of globalization, liberalization and consumerism in India. This is what happening in India under the auspices of MNCs and trade policies of developed countries which are supposedly formulated to devour the third world consumer kingdom.

Information Technology is growing faster than any other communication vehicle in the history mankind.[1] Invention of digital technology was the most important revolution in the last century. The influence of digital technology on information technology is phenomenal. The present millennium is witnessing a new culture that is internet culture. It is changing our life style and way of doing business form traditional commerce to e-commerce. Originally confined to military establishment internet[2] has due to its speed, intercreativity and flexibility, tremendous potential to disseminated information beyond the geographical boundaries. Today the internet is not only used for educational purposes but also for business. The availability of radio, telephone, television and computer made it possible to carry out most of the business activities on-line, through the information technology and communication network. The government of India by passing IT (Information Technology) Act 2000 and further amending it on 27th October 2009 has given fillip to cyber law. But various issues are not specifically covered by the Act, such as copyright, payment issues, media convergence, domain name, cybersquating and jurisdiction. While these have wide ranging ramifications for the growth of e-commerce of India.

The Consumer Protection (Amendment) Act

The year 1986
is a ‘Magna Carta’ in the history of Consumerism. It was this year that witnessed the enactment of the Consumer Protection Act. The first ever legislation in India of its kind which solely aimed at the grief staken consumers who the victims of the unfair trade practices and sub standard services rendered to them. The preamble to this Act reads as follows: An Act to provide for better protection of the interests of the consumers and to make provisions for the establishment of consumer councils and other authorities for the settlement of consumers’ disputes and fpr matter connected therewith.Thus the preamble to this Act makes the intention of the framers of this Act crystal clear .

Family Courts in India: An Overview

It is not unknown that a gaping loophole in the Indian Judiciary is the backlog of cases. The number of cases being filed in the Supreme Court is consistently on the rise. 34683 cases were filed in Supreme Court in the year 1999, whereas, 70350 were filed in the year 2008, the increase being about 103% nine years. There are cases dealing with a broad spectrum of issues such as family matters and property which continue for generations. Such cases continue for atrocious periods of time, ranging from 7 years to 30 years. In such a scenario, the channelling of cases to different courts set up specially for this purpose not only ensures their speedy disposal, but also ensures that the cases, being dealt by with experts in courts specially set up for this purpose; are dealt with more effectively. The saying that “justice delayed is justice denied” then becomes relevant to take into consideration.

The Domestic Violence Act - Fundamental rights perspective

Domestic violence is sadly a reality in Indian society, a truism. In the Indian patriarchal setup, it became an acceptable practice to abuse women. There may be many reasons for the occurrence of domestic violence. From a feminist standpoint, it could be said that the occurrence of domestic violence against women arises out of the patriarchal setup, the stereotyping of gender roles and the distribution of power, real or perceived, in society. Following such ideology, men are believed to be stronger than women and more powerful. They control women and their lives and as a result of this power play, they may hurt women with impunity. The role of the woman is to accept her ‘fate’ and the violence employed against her meekly. For long, the fairer sex has suffered at the hands of men, the exploitation ranges from physical to intangible abuse like mental and psychological torture. Women have been treated as child bearing machines, and if I may, then preferably male child bearing machines, push-over, to nothing but animals at the hands of men. Domestic violence is one of the gravest and the most pervasive human rights violation. For too long now, women have accepted it as their destiny or have just acquiescence their right to raise their voice, perhaps, because of the justice system or the lack of it or because they are vulnerable, scared of being ostracized by their own because domestic violence still remains a taboo for most women who suffer from it or for other reasons best known to them. But not any more! Women gear up-take control because of the domestic violence act, 2005.
